Chad Daybell may be among 48 witnesses in the Lori Vallow Daybell case
Lori Vallow Daybell’s husband Chad Daybell may be called as a witness in Vallow Dabell’s preliminary hearing scheduled for May, according to a new report for EastIdahoNews.com.
- Vallow Daybell is currently sitting in the Madison County jail on a $1 million bond. She faces charges of desertion and nonsupport.
- Lori Vallow’s two children — Joshua “JJ” Vallow, 7, and Tylee Ryan, 17 — have been missing since September 2019.
The potential witnesses
According to EastIdahoNews.com, Madison County Prosecuting Attorney Rob Wood submitted a list of 48 witnesses who could be called as witnesses for the upcoming preliminary hearing.
- Chad Daybell is listed as one of the witnesses.
- Melanie Gibb, a friend of Lori Vallow Daybell, is listed, too.
- Other potential witnesses include Colby Ryan, the oldest son of Lori Vallow, and Larry and Kay Woodcock, the grandparents to Joshua “JJ” Vallow.
Why Chad Daybell could testify
- According to the Idaho Rules of Evidence, Chad Daybell can not claim husband-wife privilege in the case, which means anything the two shared between each other no longer confidential and could be shared in open court.
- One of the rules centers around child-related communications, which reads: “In a criminal or civil action or proceeding as to a communication relevant to an issue concerning the physical, mental or emotional condition of or injury to a child, or concerning the welfare of a child including, but not limited to the abuse, abandonment or neglect of a child.”
When’s the next court date?
Vallow Daybell is scheduled for a bail reduction hearing on May 1.
